Abstrakt

The paper addresses a real, serious, and worsening global problem that conflicting national data protection laws between an investment host state and an investment home state have increasingly led to disputes in the sales of goods and providing services both in domestic and international contexts. This is because multinational enterprises, their shareholders, and markets are often located in different countries having conflicting laws, without sufficient grounds or experience of trust to share and access data. It has created trans-Atlantic data sharing disputes in Schrems I and II. Between China and the USA as well as its allies, conflicting national data protection laws, plus the geo-political tension, have increasingly excluded Chinese traders and investors from accessing foreign markets. It explores the legal interrelations between three actors (big tech companies, states, and consumers) in related to three themes---transparency, security, and privacy of data access---in the contexts of trade and investment with China. Analysing national laws, international free trade or digital economy agreements, and bilateral investment treaties, it suggests treaty negotiations and best practices for digital trade and investment both in the general sense and those especially with China.
